SHERIFF’S NOTICE OF PUBLIC AUCTION SALE
The Honorable Court rendered a Decision dated 2 December 2013, the dispositive portion of which reads:
WHEREFORE, in view of the foregoing, defendants, are hereby directed to:
1. Pay to plaintiff, within ninety (90) days from finality of this judgment, the principal amount of ONE MILLION TWO HUNDRED THOUSAND PESOS (Php 1,2000,000.00) and indemnity interest at the legal rate of Six percent (6%) per annum from 14 February 2013 until full payment of the loan obligation, which amounts to ONE MILLION TWO HUNDRED FIFTY FOUR THOUSAND PESOS (Php 1,254,000.00) as of t 14 November 2013, and
2. In case defendants fail to pay the amount due within the period provided, the property covered by Transfer Certificate of Title No. T-62759 in the name of defendant Jovito S. Anitap, married to Tito Anitap, shall be sold to public auction to satisfy the judgment.
3. Pay the cost of the suit.
SO ORDERED.”
WHEREFORE,by virtue of the above-mentioned Decision and failure of the defendants to pay, the undersigned will sell at PUBLIC AUTTION to the highest bidder for CASH and in Philippine Currency on 19 JUNE 2014 at 10:00 o’clock in the morning or soon thereafter in front of the Bulwagan ng Katarungan, (Benguet Justice Hall) Justice Hill, La Trinidad, Benguet, Philippines , the parcel of registered land, subject matter of the above-entitled case, more particularly described as follows, to wit:
TRASFER CERTIFICATE OF TITLE NO. T-62759 REGISTER OF DEEDS OF PROVINCE OF BENGUET
“A parcel of land (Lot 3, Pcs-CAR-001067), being a portion of consolidated lots of Lots 3-A & 3-B, Psd-131114-003702. Rurban Code of 131114. Situated at Barangay of Central, Municipality of Tublay, Province of Benguet, Island of Luzon. Bounded on the NE., & NW., along lines 1-2-3 by Lot 2 of the consolidation subdivision plan; on the NE., & SE., along lines 3-4-5 by Lot 2, Psd-1-06068; on the SW., along line 5-6 by Laoyan; on the NW., along line 6-7 by Public Land on the NE., along line 7-8 by Tublay – Baguio Road., on the SE., & NE., along line 8-9-1 by Lot 1 of the consolidation subdivision plan. Beginning at a point marked “1” on plan, S. 66 deg. 42’W., 767.20 m. from BLLM No. 1 Chomolpot, Mun. Of Tublay, x x x x x x containing an area of TWENTY SEVEN THOUSAND NINE HUNDRED FOUR (27,904) SQUARE METRS more or less.
Prospective bidder/buyers may investigate the above-described real property regarding the encumbrances thereof, if any. In case of failure in the auction sale, in the stated date, time and place, the same is hereby rescheduled on 10 July 2014 at the same time and place without further notice.
Let the foregoing be published in THE JUNCTION Newspaper, for three (3) consecutive weeks and the same be posted at the Municipal Hall, and Post Office at Tublay, Benguet; Bulletin board of RTC-OCC-Benguet, RTC Branch 62, La Trinidad, Benguet for Twenty (20) days before the scheduled public auction sale pursuant to the provisions of Rule 39, of the Revised Rules of Court of the Philippines.
